These Terms of Use (hereinafter referred to as “Terms”) govern the use of services provided by Toru Shirai (hereinafter referred to as “Author”) through “Myterry” (hereinafter referred to as “Service”). Users of this Service (hereinafter referred to as “Users”) are required to use the Service in accordance with these Terms.
Article 1 (Applicability)
- These Terms shall apply to all relationships related to the use of the Service between Users and the Author.
- The Author may establish various rules (hereinafter referred to as “Individual Provisions”) in addition to these Terms regarding the use of the Service. Regardless of their name, these Individual Provisions shall constitute a part of these Terms.
- In the event of any conflict between the provisions of these Terms and the Individual Provisions, the provisions of the Individual Provisions shall take precedence unless otherwise stipulated in the Individual Provisions.
Article 2 (Registration)
- Registration for the Service shall be completed when applicants agree to these Terms in the manner prescribed by the Author.
- The Author may cancel the registration of applicants if it determines that any of the following circumstances apply, and shall not be obliged to disclose the reasons:
- Providing false information during the registration application.
- Application from someone who has previously violated these Terms.
- Any other circumstance that the Author deems the registration to be inappropriate.
Article 3 (Prohibited Activities)
Users shall not engage in any of the following activities while using the Service:
- Actions that violate laws or public order and morals.
- Actions related to criminal activity.
- Infringement of copyrights, trademarks, and other intellectual property rights contained within the Service.
- Destruction or interference with the functions of the Author, other Users, or third parties’ servers or networks.
- Commercial use of information obtained through the Service.
- Actions that may interfere with the operation of the Author’s services.
- Unauthorized access or attempts thereof.
- Collection or accumulation of personal information about other Users.
- Use of the Service for illegal purposes.
- Actions that cause disadvantage, damage, or discomfort to other Users or third parties.
- Impersonating other Users.
- Advertising, soliciting, or commercial activities on the Service without the Author’s permission.
- Activities aimed at meeting unknown individuals of the opposite sex.
- Directly or indirectly providing benefits to anti-social forces in relation to the Author’s services.
- Any other actions deemed inappropriate by the Author.
Article 4 (Suspension of Service Provision)
The Author may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following circumstances exist:
- Maintenance or updates of the computer systems related to the Service.
- Difficulty in providing the Service due to natural disasters such as earthquakes, lightning, fire, power outages, or other unavoidable circumstances.
- Disruption of computers or communication lines due to accidents.
- Any other circumstances that the Author deems the provision of the Service to be difficult.
The Author shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the Service.
Article 5 (Use Restrictions and Registration Cancellation)
The Author may, without prior notice, restrict Users from using all or part of the Service or cancel their registration if it determines that any of the following applies:
- Violation of any provision of these Terms.
- Discovery of false information in the registration details.
- No response to communications from the Author within a certain period.
- No use of the Service for a certain period after the last use.
- Any other circumstances that the Author deems the use of the Service to be inappropriate.
The Author shall not be liable for any damages incurred by Users due to actions taken under this article.
Article 6 (Withdrawal)
Users may withdraw from the Service by following the withdrawal procedures prescribed by the Author.
Article 7 (Disclaimer of Warranty and Liability)
- The Author does not explicitly or implicitly guarantee that the Service is free from any defects (including safety, reliability, accuracy, completeness, effectiveness, compatibility with specific purposes, security, errors, bugs, or infringement of rights).
- The Author shall not be liable for any damages incurred by Users arising from the Service.
- The Author shall not be liable for any transactions, communications, or disputes arising between Users and other Users or third parties in relation to the Service.
Article 8 (Changes to Service Content)
The Author may change the content of the Service or discontinue its provision without notifying Users and shall not be liable for any damages incurred by Users as a result.
Article 9 (Changes to Terms)
The Author may change these Terms at any time without notifying Users if deemed necessary. If Users start using the Service after changes to these Terms, they shall be deemed to have agreed to the revised Terms.
Article 10 (Notifications)
Notifications or communications between Users and the Author shall be conducted in the manner prescribed by the Author.
Article 11 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their status under the usage contract or rights and obligations under these Terms to third parties without prior written consent from the Author.
Article 12 (Governing Law and Jurisdiction)
- The governing law for the interpretation of these Terms shall be Japanese law.
- In the event of any disputes arising in relation to the Service, the court having exclusive jurisdiction over the Author’s location shall be the competent court.
